Terms & Conditions of Carriage


Definitions

In these Conditions:
"The Carrier" means Solent Dolphin company number 2399830 (England & Wales) whose registered office is at The Old School House, Claypits Lane, Dibden, Southampton SO45 5TN registered charity number 900604.
"Skipper" means the person appointed by the Board of Directors who is responsible for the safety of the boat and all on board whilst under their command
"Passenger" means the person who signs the Manifest and shall include all persons travelling under the manifest.
"Volunteer" includes any operator of the vessel who may at the request of or by agreement with the Carrier (whether express or implied) perform the whole or any part of the carriage of passengers which the Carrier has agreed to undertake.

Passengers

Any person under the age of 18 must be accompanied by an adult (someone over 18 years).

Any person unable to live independently must be accompanied by an adult who is experienced to take care of their personal and social needs. Group leaders need also to consider whether the ratio of carers to disabled passengers is sufficient for the overall safety and wellbeing of the group in the event of an emergency. A group leader is anyone from a third party organisation who is identified on the day with responsibility for their group.

Cancellation of or alteration to services

Any trip may be cancelled or postponed in the event of bad weather or, very rarely, due to unforeseen circumstances. The Skippers will make the decision and their word will be final. In these circumstances we will give you as much notice as possible and re-arrange another date if possible.

The Carrier reserves the right to interrupt, vary or divert the sailing when in the opinion of the Skipper it may be expedient owing to the weather or any other cause.

Important Medical Information

Please check with your GP prior to booking if you are unsure if you or any member of your party may be affected by the impact or motion of the boat on the water. It is the responsibility of the person confirming the booking to ensure that all members of their group are made aware of this and we are notified accordingly.
Alcohol, drugs or behaviour compromising safety

Any passenger who has consumed alcohol, or is under the influence of drugs causing impaired reaction, or displaying behaviour likely to compromise safety - will not be allowed to board the boat. The Skipper's decision in this matter is final.

Personal effects and valuables

The Carrier does not accept any liability for any loss of or damage to the Passenger's property arising off the Carrier's vessel whether or not such loss is caused by the negligence or fault of the Carrier or its volunteers. The Carrier shall not be liable for the act, neglect or default of it volunteers acting outside the scope of their role.
You are solely responsible for your personal belongings whilst travelling with us. Any valuables taken aboard are done entirely at your own risk and we accept no responsibility for them whatsoever. Particular care should be taken with mobile phones, camera equipment and any valuables and steps to avoid them getting wet or lost overboard should be taken if you choose to take them onboard.
The Skipper may refuse to carry any Passenger or luggage for any reason relating to safety of the vessel or any property on board the vessel or to the safety, comfort or convenience of any other Passengers.

Lost property

The Carrier shall not be liable for loss of or from or for damage or delay to or for detention of any property, which is left on the Carrier's vessel.

Liability of the Carrier's volunteers

The Carrier in making these conditions does so for itself and for and on behalf of each and every one of its volunteers. The acceptance by signing the manifest shall be conclusive evidence of the agreement that all rights, exemptions from and limitations of liability afforded to the Carrier by these conditions shall extend to each volunteer acting within the scope of their role and all such persons shall be deemed to be parties to the contract of which these Conditions form part. The performance or prospective performance by such persons of any duties or services in any way related to such contract shall be deemed to be good consideration moving from such persons to the Passenger.

Data Protection

Solent Dolphin is exempt from registration under the Data Protection Act (DPA) and The Information Commissioners Office has confirmed that it is not therefore subject to GDPR. We nevertheless adhere to the principles of the DPA and the information given by you will be used solely by us in order to process your booking and will be stored for our use, being kept as a record of your trip. Your data will not be shared with third parties without your prior consent.

Safety

Neither the Health & Safety at Work 1974 legislation nor the Merchant Shipping and Fishing Vessels (Health & Safety at Work) Regulations 1997 apply to Solent Dolphin. The Charity, however, adheres to the principles of the Inland Waters Small Passenger Boat Code. Internal Risk Assessments are completed to take account of the health and safety of all its volunteers including passengers once on board the boat. Whilst the crew will ensure that passengers boarding are assisted to prevent a fall no liability whatsoever will be accepted by the charity until passengers are actually on board.

All passengers will be given a safety briefing by the Skipper immediately prior to departure. All passengers are required to pay attention to the safety information given. Please make the Skipper aware of any medical conditions or disabilities that may affect you or a member of your group whilst aboard. Details can be given privately by speaking to the Skipper / Crew on arrival or to the Co-ordinator at the time of booking.

All passengers shall be bound by and shall comply with all regulations and orders made or given from time to time by the Carrier or the Skipper with respect to Passengers and their luggage. The Carrier will not accept dangerous goods for carriage such as inflammables, explosives, corrosives and loaded firearms.

Injury

We will file a report for any significant injuries or accidents sustained whilst afloat and any minor injury or 'near-miss' will also be recorded and filed. Please immediately inform the Skipper of any injury sustained as soon as it happens in order that we can adequately assess the situation, offer first aid where necessary or summon further medical assistance. Please inform the Skipper if you experience any unusual discomfort which may be indicative of more significant issues.

A copy of the Insurance Policy can be provided on request.

The Skipper's decision

The Skipper's decision on marine and safety matters is final. No volunteer has authority to waive or vary this contract or any of these Conditions. Neither do Skippers have authority to resolve disputes which should be addressed to the General Secretary at 18 Oberfield Road, Brockenhurst SO42 7QF or call 01590 622514.

Law and interpretation

This contract shall be governed by and construed in accordance with English law and the parties submit to the exclusive jurisdiction of the English Courts.
